TERMS AND CONDITIONS

8 BOOKS A YEAR is an international, interdisciplinary, non-fiction book subscription curated by Christian Kaspar Schwarm and operated by Schwarm Szmania GmbH, Kalckreuthstraße 16, 10777 Berlin, Germany. These Terms and Conditions govern your subscription to 8 BOOKS A YEAR.

SUBSCRIPTION

The subscription comprises 8 books that will be sent to you in 8 separate deliveries over the course of 1 year. The topics covered by the books will vary, as will the books’ authors, publishers and physical format. All books, however, will be non-fiction, and most of the books will be in English or include an English translation. Each book will be accompanied by an introductory text.

ORDER PROCESS

After you have completed the request subscription form on 8 BOOKS A YEAR’s website and clicked the request subscription button, 8 BOOKS A YEAR will examine your request and send you an invoice. Only upon receipt of your payment via bank transfer or via Paypal, the subscription agreement is bindingly concluded. You will receive 8 separate books during the course of 1 year.

DELIVERY PERIOD

The delivery period for your first book depends on the time of your payment. In average, 8 BOOKS A YEAR dispatches 1 book per 6 weeks. Usually, 8 BOOKS A YEAR will dispatch your first book within 2 months from receipt of your payment the latest. Please note that mail delivery times may vary depending on your location.

NO AUTOMATIC RENEWAL

There is no automatic renewal of your subscription. Towards the end of your subscription, you will be sent a reminder that your subscription is going to expire. If you don’t want to receive further books, you don’t have to do anything. If you wish to subscribe for another year, just pay the subscription fee for that following year as indicated in the reminder. Your subscription will be renewed upon receipt of your payment.

SUBSCRIPTION FEE

The fee for a 1 year subscription is currently 375 Euros.

SHIPPING FEE FOR INTERNATIONAL DELIVERIES

For deliveries outside Germany, a shipping fee applies. The shipping fee is currently 70 Euros within the EU, 100 Euros for an European but Non-EU shipping address and 250 Euros for the rest of the world. The shipping fee will be invoiced together with the subscription fee. The shipping fee covers the entire 1 year subscription. For deliveries within Germany, no shipping fee applies.

VAT AND CUSTOM DUTY

For deliveries within the EU only, the subscription fee and the shipping fee are inclusive of German VAT (7 %). If you are an EU entrepreneur outside Germany and wish the VAT reverse charge mechanism to apply, you may enter your VAT ID number in the comments field and 8 BOOKS A YEAR will discount the German VAT from the subscription fee and the shipping fee. You are responsible for any taxation and customs duty that may apply in the destination country.

WITHDRAWAL RIGHT

If you are a consumer, you may withdraw from the subscription within 14 days without giving any reason. The withdrawal period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the first book. For exercising the withdrawal right, you must inform 8 BOOKS A YEAR, Schwarm Szmania GmbH, Kalckreuthstraße 16, 10777 Berlin, Germany, withdrawal@8booksayear.com of your decision to withdraw from the subscription by an unequivocal statement. You may use the model withdrawal form that will be attached to your invoice, but it is not obligatory. In order to observe the deadline, timely dispatch of the notice of withdrawal suffices.

CONSEQUENCES OF WITHDRAWAL

If you withdraw from your subscription, 8 BOOKS A YEAR will reimburse all payments received from you (including shipping costs) without undue delay and in any event no later than 14 days from the day on which 8 BOOKS A YEAR has been informed about your decision to withdraw from the subscription. The reimbursement will be carried out using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise. No fees will be charged for the reimbursement. 8 BOOKS A YEAR may withhold reimbursement until you have returned any books received or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall return the books received to 8 BOOKS A YEAR, Schwarm Szmania GmbH, Kalckreuthstraße 16, 10777 Berlin, Germany, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to 8 BOOKS A YEAR. In order to observe the deadline, timely dispatch of the books suffices. You will have to bear the direct cost of returning the books. Please note that you are liable for any diminished value of the books resulting from the handling of the books other than what is necessary to establish nature, characteristics and functioning of the books. APPLICABLE LAW

Your subscription to 8 BOOKS A YEAR and these Terms and Conditions are governed by the laws of the Federal Republic of Germany. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

The following provisions describe the type, scope and purpose of collecting, processing and utilizing personal data. This data privacy policy applies only to our web pages. If links on our pages route you to other pages, please inquire there about how your data are handled in such cases.

COLLECTION, PROCESSING AND USE OF PERSONAL DATA

8 BOOKS A YEAR collects the personal data that you enter or otherwise explicitly communicate during the use of the website including the subscription process to the extent required for processing your subscription only. 8 BOOKS A YEAR will not use the data for any other purpose without your explicit consent. After complete processing of your subscription and after expiry of all statutory storage obligations, your personal data will be deleted, unless you have explicitly consented to their continued use. Any such consent is freely revocable.

DISCLOSURE TO THIRD PARTIES

8 BOOKS A YEAR will not disclose your personal data to third parties without your explicit and freely revocable consent, except for its service partners to the extent disclosure is required for processing your subscription (e.g. shipping).

GOOGLE ANALYTICS

This website uses Google Analytics, a web analytics service provided by Google, Inc., Mountain View, CA, USA (“Google”). Google Analytics uses cookies to help the website analyse how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google.

In your browser settings, you can deactivate cookies, restrict the storage of cookies to defined websites or you can set the browser to inform you as soon as a cookie will be placed. You can also delete cookies from your hard drive at any time.
